Este trabalho analisa a Administração Pública e o poder regulamentar das agências reguladoras no Brasil, a partir da Constituição de 1988. Utilizam-se a pesquisa bibliográfica e o método dedutivo. Constata-se que essas agências foram criadas, no Brasil, em um contexto de transformação do Estado, que buscava afastar-se da intervenção direta na ordem econômica e adotar um modelo gerencial, focado mais na fiscalização e regulação dos serviços públicos, do que em sua prestação direta. Os resultados indicam que os limites do poder (...) regulamentar dessas agências, entretanto, é objeto de controvérsia, face aos limites decorrentes do princípio da legalidade. (shrink)

RESUMO : Será que um dia serão desenvolvidos computadores digitais capazes de pensar de modo similar ao nosso? Ou será que, independentemente da tecnologia, os computadores digitais estarão sempre limitados a manipularem dados sem compreendê-los? Neste trabalho, apresentarei duas concepções antagônicas de Filosofia da Mente: a Inteligência Artificial Forte, que responde afirmativamente à primeira questão, e a crítica de John Searle a esta corrente, que, por sua vez, responde de maneira afi rmativa à segunda questão. Para tanto, iniciarei o artigo (...) apresentando o famoso jogo da imitação proposto por Alan Turing para decidir se uma máquina é ou não inteligente, jogo este que ficou conhecido como teste de Turing. Logo em seguida, analisarei minuciosamente o experimento mental do quarto chinês, que é uma crítica ao teste de Turing e ao programa de pesquisa da Inteligência Artificial Forte. Este artigo propõe-se a discutir, sob o paradigma do Estado Democrático de Direito, em que medida a aplicação da cota de gênero contribui para fomentar a representatividade feminina na política. Utilizam-se a pesquisa bibliográfica e o método jurídico-dedutivo. Os resultados sinalizam que não há uma correlação necessária entre o preenchimento da cota de gênero e o incremento do número de candidatas eleitas. Os resultados apontam que a superação dessa desigualdade requer a discussão de outras possibilidades, tais como reserva de vagas (...) no Legislativo, combate às candidaturas femininas fictícias e aplicação obrigatória de recursos nas campanhas femininas. We approach the subject of o-minimality from the point of view of tame systems, following the work of Charbonnel and Wilkie. This gives some general sufficient conditions for a system to be model complete and o-minimal. We are then able to obtain the following generalisation of a recent result of Gabrielov : A polynomially bounded o-minimal expansion of the real ordered field by a collection of restricted C∝ functions, which is closed under partial differentiation, is model complete.

O artigo examina a concepção de Searle sobre a redução da consciência (em especial a sua teoria acerca de seus poderes causais), que se mostra obscura e incoerente. Porém, essa incoerência não é inevitável, pois o naturalismo biológico possui elementos que permitiriam a articulação de uma teoria mais clara a respeito das capacidades causais. O exame da teoria de Pereboom e Kornblith possibilita entender por que a afirmação de identidade das capacidades causais leva a um reducionismo. Essa teoria aponta um (...) caminho promissor para que se possa aprimorar o naturalismo biológico. (shrink)

Taken together with my previous articles [77], [80] devoted to the history of finite random sums and to Laplace's theory of errors, this paper sheds sufficient light on the whole work of Laplace in probability. Laplace's theory of probability is subdivided into theory of probability proper, limit theorems and mathematical statistics (not yet distinguished as a separate entity). I maintain that in its very design Laplace's theory of probability is a discipline pertaining to natural science rather than to mathematics. I (...) maintain also the idea that the so-called Laplacian determinism was no hindrance to applications of his theory of probability to natural science and that one of his utterances in this connection could have well been made by Maxwell's contemporaries. Two possible reasons why the theory of probability stagnated after Laplace's work are singled out: the absence of new fields of application and, also, the insufficient level of mathematical abstraction used by Laplace. For all his achievements, I reach the general conclusion that he did not originate the theory of probability as it is now known. (shrink)

O objetivo deste trabalho é apresentar a filosofia de Kant e o pensamento de Bohr como formas de conhecimento que se encontram, segundo alguns comentadores, a partir de conceitos da física clássica. Ademais, a epistemologia de Kant apresentou grande aproximação com a filosofia natural de Newton e, conceitualmente, alguns limites de fronteira com a filosofia da física quântica, se consideramos a fase inicial da mecânica clássica. Tais conceitos limítrofes adquiriram forma na física de Bohr e, por sua vez, se modificaram (...) no pensamento do físico dinamarquês. Assim, aborda-se aqui a posição de Bohr sobre conceitos aproximados da filosofia kantiana, pelo viés clássico da preservação de conceitos como espaço, tempo, realismo e causalidade da física. Por outro lado, serão apresentados argumentos que indicam como não se sustentam todas as interpretações que construíram um “Bohr kantiano”. (shrink)

This is the first in a series of papers in which a method of harmonic analysis in terms of functions over the groupSU(2) is applied to the description of interaction between matter and the electromagnetic field. Carmeli'sSU(2) formulation of Maxwell's equations is extended to anSU(2) formulation of the equations for the electromagnetic vector potential. The four functions which describe the vector potential are expanded in a generalized Fourier series [SU(2) harmonic analysis] and the equations for the coefficients are derived. (...) The single postulate of Coulomb-Clausius potential between charges allows one to derive all of Maxwell's equations with an explicit form for polarizability.

Using the linearized Einstein gravitational field equations and the Maxwell field equations it is shown that the plane of polarization of an electromagnetic wave is rotated by the gravitational field created by the electromagnetic radiation of a ring laser. It is further shown that this gravitational Faraday effect shares many of the properties of the standard electromagnetic Faraday effect. An experimental arrangement is then suggested for the observation of this gravitational Faraday effect induced by the ring laser.

We review the relativistic classical and quantum mechanics of Stueckelberg, and introduce the compensation fields necessary for the gauge covariance of the Stueckelbert–Schrödinger equation. To achieve this, one must introduce a fifth, Lorentz scalar, compensation field, in addition to the four vector fields with compensate the action of the space-time derivatives. A generalized Lorentz force can be derived from the classical Hamilton equations associated with this evolution function. We show that the fifth (scalar) field can be eliminated through the introduction (...) of a conformal metric on the spacetime manifold. The geodesic equation associated with this metric coincides with the Lorentz force, and is therefore dynamically equivalent. Since the generalized Maxwell equations for the five dimensional fields provide an equation relating the fifth field with the spacetime density of events, one can derive the spacetime event density associated with the Friedmann–Robertson–Walker solution of the Einstein equations. The resulting density, in the conformal coordinate space, is isotropic and homogeneous, decreasing as the square of the Robertson–Walker scale factor. Using the Einstein equations, one see that both for the static and matter dominated models, the conformal time slice in which the events which generate the world lines are contained becomes progressively thinner as the inverse square of the scale factor, establishing a simple correspondence between the configurations predicted by the underlying Friedmann–Robertson–Walker dynamical model and the configurations in the conformal coordinates. We apply a method analogous to the eikonal approximation to the Maxwell wave equations in an inhomogeneous anisotropic medium and geodesic motion in a three dimensional Riemannian manifold, using a method which identifies the symplectic structure of the corresponding mechanics, to the five dimensional generalization of Maxwell theory required by the gauge invariance of Stueckelberg's covariant classical and quantum dynamics. In this way, we demonstrate, in the eikonal approximation, the existence of geodesic motion for the flow of mass (...) in a four dimensional pseudo-Riemannian manifold. These results provide a foundation for the geometrical optics of the five dimensional radiation theory and establish a model in which there is mass flow along geodesics. We then discuss the interesting case of relativistic quantum theory in an anisotropic medium as well. In this case the eikonal approximation to the relativistic quantum mechanical current coincides with the geodesic flow governed by the pseudo-Riemannian metric obtained from the eikonal approximation to solutions of the Stueckelberg–Schrödinger equation. The locally symplectic structure which emerges is that of a generally covariant form of Stueckelberg's mechanics on this manifold. (shrink)

It has been shown by Gupta and Padmanabhan that the radiation reaction force of the Abraham–Lorentz–Dirac equation can be obtained by a coordinate transformation from the inertial frame of an accelerating charged particle to that of the laboratory. We show that the problem may be formulated in a flat space of five dimensions, with five corresponding gauge fields in the framework of the classical version of a fully gauge covariant form of the Stueckelberg–Feynman–Schwinger covariant mechanics (the zero mode fields of (...) the 0, 1, 2, 3 components correspond to the Maxwell fields). Without additional constraints, the particles and fields are not confined to their mass shells. We show that in the mass-shell limit, the generalized Lorentz force obtained by means of the retarded Green's functions for the five dimensional field equations provides the classical Abraham–Lorentz–Dirac radiation reaction terms (with renormalized mass and charge). We also obtain general coupled equations for the orbit and the off-shell dynamical mass during the evolution as well as an autonomous non-linear equation of third order for the off-shell mass. The theory does not admit radiation if the particle does not move off-shell. The structure of the equations implies that mass-shell deviation is bounded when the external field is removed. (shrink)

The nonlinear integro-differential equation, obtained from the coupled Maxwell-Dirac equations by eliminating the potential Aμ, is solved by iteration rather than perturbation. The energy shift is complex, the imaginary part giving the spontaneous emission. Both self-energy and vacuum polarization terms are obtained. All results, including renormalization terms, are finite.

The incongruence between quantum theory and relativity theory is traced to the probability interpretation of the former. The classical continium interpretation of ψ removes the difficulty. How quantum properties of matter and light, and in particular the radiative problems, like spontaneous emission and Lamb shift, may be accounted in a first quantized Maxwell-Dirac system is discussed.

Book review of Meir Hemmo and Orly Shenker's book "The Road to Maxwell's Demon: Conceptual Foundations of Statistical Mechanics.".

This book argues for the need to put into practice a profound and comprehensive intellectual revolution, affecting to a greater or lesser extent all branches of scientific and technological research, scholarship and education. This intellectual revolution differs, however, from the now familiar kind of scientific revolution described by Kuhn. It does not primarily involve a radical change in what we take to be knowledge about some aspect of the world, a change of paradigm. Rather it involves a radical change in (...) the fundamental, overall intellectual aims and methods of inquiry. At present inquiry is devoted to the enhancement of knowledge. This needs to be transformed into a kind of rational inquiry having as its basic aim to enhance personal and social wisdom. This new kind of inquiry gives intellectual priority to the personal and social problems we encounter in our lives as we strive to realize what is desirable and of value – problems of knowledge and technology being intellectually subordinate and secondary. For this new kind of inquiry, it is what we do and what we are that ultimately matters: our knowledge is but an aspect of our life and being. (shrink)

In _Neuroscience and Philosophy_ three prominent philosophers and a leading neuroscientist clash over the conceptual presuppositions of cognitive neuroscience. The book begins with an excerpt from Maxwell Bennett and Peter Hacker's _Philosophical Foundations of Neuroscience_ (Blackwell, 2003), which questions the conceptual commitments of cognitive neuroscientists. Their position is then criticized by Daniel Dennett and John Searle, two philosophers who have written extensively on the subject, and Bennett and Hacker in turn respond. Their impassioned debate encompasses a wide range of (...) central themes: the nature of consciousness, the bearer and location of psychological attributes, the intelligibility of so-called brain maps and representations, the notion of qualia, the coherence of the notion of an intentional stance, and the relationships between mind, brain, and body. Clearly argued and thoroughly engaging, the authors present fundamentally different conceptions of philosophical method, cognitive-neuroscientific explanation, and human nature, and their exchange will appeal to anyone interested in the relation of mind to brain, of psychology to neuroscience, of causal to rational explanation, and of consciousness to self-consciousness. In his conclusion Daniel Robinson (member of the philosophy faculty at Oxford University and Distinguished Professor Emeritus at Georgetown University) explains why this confrontation is so crucial to the understanding of neuroscientific research. The project of cognitive neuroscience, he asserts, depends on the incorporation of human nature into the framework of science itself. In Robinson's estimation, Dennett and Searle fail to support this undertaking; Bennett and Hacker suggest that the project itself might be based on a conceptual mistake. Exciting and challenging, _Neuroscience and Philosophy_ is an exceptional introduction to the philosophical problems raised by cognitive neuroscience. (shrink)

O presente ensaio se insere no âmbito da Filosofia Moderna (séculos XVII-XX), com ênfase numa problemática compartilhada pela Metafísica da mente e pela Filosofia da Física. De um ponto de vista histórico-conceitual, trata-se de retomar a contribuição de Henri Bergson para a compreensão do significado filosófico da Física moderna. Para tanto, projeta-se aqui (i) reconstituir, por uma abordagem histórico-conceptual, a mudança operada no conceito de matéria quando da ruptura entre a Filosofia Natural Clássica e a Filosofia Natural Moderna; (ii) indicar (...) como a prioridade ou o abandono do conceito de matéria ocasionou uma cisão interna na Filosofia Natural Moderna; (iii) mostrar que, segundo Bergson, o problema mente-corpo se origina da concepção cartesiana de matéria e dos desdobramentos desta em outras filosofias; (iv) examinar como Bergson assume criticamente uma concepção de matéria familiar as de J. Maxwell, J. Thomson e M. Faraday; (v) mostrar assim que a originalidade de Bergson consiste em estabelecer a distinção entre dois tipos de “extensão” (“_l’étendue_” e “_l’extension_”), que, se estiverem amparadas na experiência como se espera, suprimem as contradições dos dualismos e autorizam afirmar tanto a realidade da matéria quanto a do “espírito”. From Knowledge to Wisdom argues that there is an urgent need, for both intellectual and humanitarian reasons, to bring about a revolution in science and the humanities. The outcome would be a kind of academic inquiry rationally devoted to helping humanity learn how to create a better world. Instead of giving priority to solving problems of knowledge, as at present, academia would devote itself to helping us solve our immense, current global problems – climate change, war, poverty, population growth, pollution... (...) of sea, earth and air, destruction of natural habitats and rapid extinction of species, injustice, tyranny, proliferation of armaments, conventional, chemical, biological and nuclear, depletion of natural resources. The basic intellectual aim of inquiry would be to seek and promote wisdom – wisdom being the capacity to realize what is of value in life for oneself and others, thus including knowledge and technological know-how, but much else besides. This second edition has been revised throughout, has additional material, a new introduction and three new chapters. (shrink)

Some organisations make vaccination a condition of employment. This means prospective employees must demonstrate they have been vaccinated (eg, against measles) to be hired. But it also means organisations must decide whether _existing_ employees should be expected to meet newly introduced vaccination conditions (eg, against COVID-19). Unlike prospective employees who will not be _hired_ if they do not meet vaccination conditions, existing employees who fail to meet new vaccination conditions risk being _fired_. The latter seems worse than the former. Hence, (...) objections to vaccination mandates commonly centre on the harms that will be visited on existing employees who are unwilling to be vaccinated. However, because this objection does not necessarily entail the claim that vaccination is unnecessary for the effective and safe performance of certain jobs, those making this objection should have less of an objection, or no objection at all (at least on these grounds), to introducing vaccination requirements in some cases for _prospective_ employees. Yet, in this paper, I shall argue that if one has reason to believe vaccination requirements can be justified for prospective employees, one should also believe they are justified for existing employees _despite_ any asymmetry in consequences experienced by the two groups. As a consequence, common objections made against vaccination mandates grounded solely in the harms that may be experienced by existing employees who are unwilling to be vaccinated should be considered unpersuasive. This chapter outlines improvements and developments made to aim-oriented empiricism since "From Knowledge to Wisdom" was first published in 1984. It argues that aim-oriented empiricism enables us to solve three fundamental problems in the philosophy of science: the problems of induction and verisimilitude, and the problem of what it means to say of a physical theory that it is unified.

Conjectures are made on the text of three passages in Tibullus, Books 1–2: 1.4.26 hastam … suam for crines … suos, 2.1.56 membra for bache, 2.4.60 aliis rebus for alias herbas.

Originally published in 1973, this book shows that methods developed for the semantics of systems of formal logic can be successfully applied to problems about the semantics of natural languages; and, moreover, that such methods can take account of features of natural language which have often been thought incapable of formal treatment, such as vagueness, context dependence and metaphorical meaning. Parts 1 and 2 set out a class of formal languages and their semantics. Parts 3 and 4 show that these (...) formal languages are rich enought to be used in the precise description of natural languages. Appendices describe some of the concepts discussed in the text. In this paper I outline my propensiton version of quantum theory (PQT). PQT is a fully micro-realistic version of quantum theory that provides us with a very natural possible solution to the fundamental wave/particle problem, and is free of the severe defects of orthodox quantum theory (OQT) as a result. PQT makes sense of the quantum world. PQT recovers all the empirical success of OQT and is, furthermore, empirically testable (although not as yet tested). I argue that Einstein almost put (...) forward this version of quantum theory in 1916/17 in his papers on spontaneous and induced radiative transitions, but retreated from doing so because he disliked the probabilistic character of the idea. Subsequently, the idea was overlooked because debates about quantum theory polarised into the Bohr/Heisenberg camp, which argued for the abandonment of realism and determinism, and the Einstein/Schrödinger camp, which argued for the retention of realism and determinism, no one, as a result, pursuing the most obvious option of retaining realism but abandoning determinism. It is this third, overlooked option that leads to PQT. PQT has implications for quantum field theory, the standard model, string theory, and cosmology. The really important point, however, is that it is experimentally testable. I indicate two experiments in principle capable of deciding between PQT and OQT. (shrink)

We present a multiscale integrationist interpretation of the boundaries of cognitive systems, using the Markov blanket formalism of the variational free energy principle. This interpretation is intended as a corrective for the philosophical debate over internalist and externalist interpretations of cognitive boundaries; we stake out a compromise position. We first survey key principles of new radical views of cognition. We then describe an internalist interpretation premised on the Markov blanket formalism. Having reviewed these accounts, we develop our positive multiscale account. (...) We argue that the statistical seclusion of internal from external states of the system—entailed by the existence of a Markov boundary—can coexist happily with the multiscale integration of the system through its dynamics. Our approach does not privilege any given boundary, nor does it argue that all boundaries are equally prescient. We argue that the relevant boundaries of cognition depend on the level being characterised and the explanatory interests that guide investigation. We approach the issue of how and where to draw the boundaries of cognitive systems through a multiscale ontology of cognitive systems, which offers a multidisciplinary research heuristic for cognitive science. Humanity faces two basic problems of learning: learning about the universe, and learning how to become civilized. We have solved the first problem, but not the second, and that puts us in a situation of great danger. Almost all our global problems have arisen as a result. It has become a matter of extreme urgency to solve the second problem. The key to that is to learn from our solution to the first problem how to solve the second one. This (...) was the basic idea of the 18th century Enlightenment, but in implementing it, the Enlightenment blundered. Their mistakes are still built into academia today. In order to create a civilized world, it is essential we cure academia of the structural blunders inherited from the Enlightenment. We need to bring about a revolution in science, and in academia more broadly so that the basic aim becomes wisdom, and not just knowledge. (shrink)

This paper presents a version of neurophenomenology based on generative modelling techniques developed in computational neuroscience and biology. Our approach can be described as _computational phenomenology_ because it applies methods originally developed in computational modelling to provide a formal model of the descriptions of lived experience in the phenomenological tradition of philosophy (e.g., the work of Edmund Husserl, Maurice Merleau-Ponty, etc.). The first section presents a brief review of the overall project to naturalize phenomenology. The second section presents and evaluates (...) philosophical objections to that project and situates our version of computational phenomenology with respect to these projects. The third section reviews the generative modelling framework. The final section presents our approach in detail. We conclude by discussing how our approach differs from previous attempts to use generative modelling to help understand consciousness. In summary, we describe a version of computational phenomenology which uses generative modelling to construct a computational model of the inferential or interpretive processes that best explain this or that kind of lived experience. There is a need to bring about a revolution in the philosophy of science, interpreted to be both the academic discipline, and the official view of the aims and methods of science upheld by the scientific community. At present both are dominated by the view that in science theories are chosen on the basis of empirical considerations alone, nothing being permanently accepted as a part of scientific knowledge independently of evidence. Biasing choice of theory in the direction of simplicity, unity (...) or explanatory power does not permanently commit science to the thesis that nature is simple or unified. This current ‘paradigm’ is, I argue, untenable. We need a new paradigm, which acknowledges that science makes a hierarchy of metaphysical assumptions concerning the comprehensibility and knowability of the universe, theories being chosen partly on the basis of compatibility with these assumptions. Eleven arguments are given for favouring this new ‘paradigm’ over the current one. (shrink)

The crisis of our times is science without wisdom. It is the outcome of an astonishingly successful tradition of scientific and technological research pursued within the context of an academic inquiry that is profoundly and damagingly irrational, in a structural way, when judged from the standpoint of helping humanity make progress towards a wise, enlightened world. This damaging irrationality of academia goes back to the 18th century Enlightenment. The philosophes of the French Enlightenment, in implementing the profound idea that we (...) might learn from scientific progress how to achieve social progress towards an enlightened world, made three gross blunders – and it is these blunders, still uncorrected, that are built into academia today, and result in its current dysfunctional character. We urgently need to correct these blunders and transform academia, so that it becomes rationally, effectively and actively engaged in helping humanity discover what to do to solve the global problems that threaten our future, and thus make progress towards a good, enlightened world. Two great problems of learning confront humanity: learning about the nature of the universe and our place in it, and learning how to become civilized. The first problem was solved, in essence, in the 17th century, with the creation of modern science. But the second problem has not yet been solved. Solving the first problem without also solving the second puts us in a situation of great danger. All our current global problems have arisen as a result. What we need (...) to do, in response to this unprecedented crisis, is learn from our solution to the first problem how to solve the second. This was the basic idea of the 18th century Enlightenment. Unfortunately, in carrying out this programme, the Enlightenment made three blunders, and it is this defective version of the Enlightenment programme that we have institutionalized in 20th century academic inquiry. In order to solve the second great problem of learning we need to correct the three blunders of the traditional Enlightenment. This involves changing the nature of social inquiry, so that social science becomes social methodology or social philosophy, concerned to help us build into social life the progress-achieving methods of aim-oriented rationality, arrived at by generalizing the progress-achieving methods of science. It also involves, more generally, bringing about a revolution in the nature of academic inquiry as a whole, so that it takes up its proper task of helping humanity learn how to become wiser by increasingly cooperatively rational means. The scientific task of improving knowledge and understanding of nature becomes a part of the broader task of improving global wisdom. (shrink)

In this paper I argue that neuroscience has been harmed by the widespread adoption of seriously inadequate methodologies or philosophies of science - most notably inductivism and falsificationism. I argue that neuroscience, in seeking to understand the human brain and mind, needs to follow in the footsteps of evolution.

In 1885, during initial discussions of J. C. Maxwell's celebrated thermodynamic demon, Whiting(1) observed that the demon-like velocity selection of molecules can occur in a gravitationally bound gas. Recently, a gravitational Maxwell demon has been proposed which makes use of this observation [D. P. Sheehan, J. Glick, and J. D. Means, Found. Phys. 30, 1227 (2000)]. Here we report on numerical simulations that detail its microscopic phase space structure. Results verify the previously hypothesized mechanism of its paradoxical behavior. (...) Consumer actions towards multinationals encompass not just expressions of dissatisfaction and ethical identity but also what are problematically termed ‘instrumental actions’ entailing perceived purposes and likely impacts. This term may seem inappropriate where insufficient information exists for instrumentally linking means to ends, yet we consider it useful for describing purposive consumer action in its subjective aspect because it reflects the psychological reality whereby complexity-reducing social constructions give consumer actions instrumentally rational form for purposes of meaningful understanding and justification. This paper (...) is particularly concerned to explore the complexities of cause and intention—particularly ethical intention—which are thus reduced. In particular, it considers complex interaction between individual ethical values, demographic factors and contexts of societal practice. It seeks to highlight primary antecedents among these interactants in order to guide both consumers and multinationals in their complexity-reducing social constructions to improve their fit to true causes and intentions. Study 1 involved 606 United Kingdom nationals, while study 2 involved 2561 individuals from 15 nations. Both sets of findings link higher personal income levels to propensity to engage in instrumental actions towards multinationals. Overwhelmingly, however, individual ethical values seem to matter most, irrespective of demographic or cultural contexts. These findings suggest that both consumers and multinationals engaged in ethical dialogue with consumers are best advised to articulate a universalising and not culturally or nationally bound ethical intelligence, which speaks directly to conscience within a global ethical discourse.
